1. ACCEPTANCE OF TERMS
1.1. These Terms and Conditions ("Terms") govern your access to and use of zimjobsite.com (the "Platform"), operated by [Company Name], a company registered in Zimbabwe under registration number [Number] with its principal place of business at [Physical Address, Zimbabwe] ("we," "us," "our," or "ZimJobSite").
1.2. By accessing or using the Platform as a job seeker, employer, recruiter, or in any other capacity ("User"), you agree to be bound by these Terms, our Privacy Policy, and any additional posted guidelines or rules applicable to specific sections of the Platform. If you do not agree to these Terms, you must not use the Platform.
1.3. We may update these Terms at any time. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.
2. ELIGIBILITY AND REGISTRATION
2.1. Minimum Age: You must be at least 18 years old to use the Platform. Zimbabwean law prohibits employment of persons under 16 years except under specific apprenticeship arrangements
2.2. Account Creation: To access certain features, you must register for an account and provide accurate, current information. You are responsible for maintaining the confidentiality of your account credentials.
2.3. Verification: We reserve the right to verify the identity and legitimacy of employers, recruiters, or job seekers through documentation or third-party verification services before granting full access to Platform features.
2.4. Single Account: You may not create multiple accounts to circumvent restrictions or manipulate the Platform's functionality.
3. TYPES OF USERS AND OBLIGATIONS
3.1. Employers and Recruiters ("Employers")
3.1.1. You warrant that you are authorized to hire employees or contractors on behalf of the organization you represent.
3.1.2. Job postings must:
- Comply with Zimbabwe's Labour Act [Chapter 28:01] and all applicable employment laws
- Not contain discriminatory language based on race, tribe, place of origin, political opinions, colour, creed, sex, pregnancy, marital status, or disability as prohibited under Zimbabwean law
- Accurately describe the position, requirements, location, and compensation structure
- Not misrepresent the nature of employment (e.g., disguising permanent positions as temporary contracts to avoid statutory obligations)
3.1.3. You shall not:
- Charge job seekers fees for applying to or securing employment (subject to limited exceptions under employment agency regulations)
- Request excessive personal information beyond what is reasonably required for recruitment
- Use the Platform to harvest candidate data for purposes unrelated to legitimate recruitment
- Post positions that violate Zimbabwean minimum wage laws or working conditions standards
3.1.4. You are solely responsible for:
- Conducting proper background checks and reference verification
- Complying with statutory obligations including written employment contracts, statutory deductions, and workplace safety requirements
- Any employment relationship formed through the Platform
3.2. Job Seekers
3.2.1. You warrant that information provided in your profile and applications is accurate, current, and not misleading.
3.2.2. You shall not:
- Apply for positions for which you knowingly lack required qualifications or eligibility to work in Zimbabwe
- Submit duplicate applications for the same position
- Use automated systems to apply to multiple positions without genuine interest
- Share login credentials or allow others to use your account to apply for positions
3.2.3. You understand that:
- ZimJobSite is a platform connecting job seekers and employers; we are not your employer nor agent
- We do not guarantee job placement, interview invitations, or employment outcomes
- You are responsible for verifying the legitimacy of employers and positions before sharing sensitive information or accepting offers
4. PROHIBITED CONTENT AND CONDUCT
You shall not post, transmit, or make available through the Platform:
4.1. Content that violates Zimbabwean law, including but not limited to:
- Material promoting illegal employment practices
- Content violating the Cyber and Data Protection Act [Chapter 12:07]
- Material that constitutes false news under applicable legislation
4.2. Discriminatory, harassing, abusive, defamatory, obscene, or threatening content
4.3. Content that infringes intellectual property rights of third parties
4.4. Unauthorized advertising, promotional materials, or spam
4.5. Malware, viruses, or content designed to disrupt Platform functionality
4.6. False or misleading information about qualifications, experience, company details, or job terms
4.7. Content soliciting passwords, payment information, or other sensitive data outside secure Platform channels
5. INTELLECTUAL PROPERTY
5.1. Platform Content: All content, features, and functionality on the Platform (including text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software) are owned by or licensed to us and protected by Zimbabwean and international copyright, trademark, and other intellectual property laws.
5.2. User-Generated Content: By posting content (job descriptions, profiles, applications), you grant ZimJobSite a worldwide, royalty-free, sublicensable license to use, reproduce, distribute, and display such content solely for Platform operations and improvement. You retain ownership of your content but warrant you have rights to share it.
5.3. Restrictions: You may not copy, modify, distribute, sell, or lease any Platform content or access without our written permission, except as expressly permitted by applicable law.
6. DATA PROTECTION AND PRIVACY
6.1. Your personal data is processed in accordance with our Privacy Policy and Zimbabwe's Cyber and Data Protection Act [Chapter 12:07]
6.2. We implement reasonable technical and organizational measures to protect personal data against unauthorized access, alteration, disclosure, or destruction.
6.3. Processing of sensitive data (including biometric, health, or genetic information) requires explicit written consent as mandated by the Cyber and Data Protection Act
6.4. You have rights to access, correct, and (subject to legal obligations) request deletion of your personal data as provided under Zimbabwean data protection law.
6.5. We may be required to register as a data controller/processor with the Postal and Telecommunications Regulatory Authority of Zimbabwe (POTRAZ) or relevant authority under current regulations
7. PAYMENTS AND FEES (IF APPLICABLE)

8.2. NO EMPLOYMENT GUARANTEE: We do not guarantee:
- Accuracy, completeness, or reliability of job postings or candidate profiles
- That any job posting complies with labour laws or represents legitimate opportunities
- That any candidate possesses qualifications claimed in their profile
- Job placement, interview opportunities, or employment outcomes
8.3. User Responsibility: You are solely responsible for:
- Verifying information provided by other Users
- Conducting due diligence before entering employment relationships
- Compliance with all applicable laws in your recruitment or job-seeking activities
8.4. Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY ZIMBABWEAN LAW, ZIMJOBSITE SHALL NOT BE LIABLE FOR:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION
- DAMAGES ARISING FROM EMPLOYMENT RELATIONSHIPS FORMED THROUGH THE PLATFORM
- ANY CONDUCT OR CONTENT OF THIRD-PARTY USERS
8.5. Maximum Liability: OUR TOTAL LIABILITY ARISING FROM OR RELATED TO THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR SERVICES IN THE [THREE] MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
8.6. Statutory Rights: Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded under Zimbabwean law.
9. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless ZimJobSite, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising from:
- Your breach of these Terms
- Your violation of any law or third-party rights
- Your use of the Platform or reliance on information obtained through it
- Any employment relationship you form through the Platform
10. TERMINATION
10.1. By You: You may terminate your account at any time through account settings.
10.2. By Us: We may suspend or terminate your access immediately without notice if you:
- Breach these Terms
- Engage in fraudulent, illegal, or harmful conduct
- Pose security or safety risks to other Users or the Platform
10.3. Effect of Termination: Upon termination:
- Your right to use the Platform ceases immediately
- We may retain your data as required by law or for legitimate business purposes
- Provisions regarding intellectual property, disclaimers, limitations of liability, indemnification, and governing law shall survive
11. GOVERNING LAW AND DISPUTE RESOLUTION
11.1. Governing Law: These Terms shall be governed by and construed in accordance with the laws of Zimbabwe.
11.2. Jurisdiction: Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Zimbabwe.
11.3. Mediation: Before initiating litigation, parties agree to attempt mediation through a mutually agreed mediator in Harare, Zimbabwe.
11.4. Class Action Waiver: To the extent permitted by law, you waive the right to participate in class actions related to these Terms.
12. MISCELLANEOUS
12.1. Entire Agreement: These Terms constitute the entire agreement between you and ZimJobSite regarding the Platform and supersede all prior agreements.
12.2. Severability: If any provision is held invalid, the remainder shall continue in full force.
12.3. Waiver: Failure to enforce any right under these Terms shall not constitute waiver of that right.
12.4. Assignment: You may not assign your rights or obligations. We may assign our rights to affiliates or successors.
12.5. Force Majeure: We shall not be liable for failures or delays due to circumstances beyond reasonable control (e.g., natural disasters, war, pandemics, government actions, internet outages).
